The two types of patents available in Australia are:
  • a standard patent, which gives long term protection and gives the patentee exclusive rights over an invention for up to 20 years. A standard patent may be granted for new products, methods or uses.
  • an innovation patent, which is a relatively quick and inexpensive protection option which can be of great benefit for smaller companies, lasts a maximum of 8 years. The inventive threshold for an innovative patent is lower compared to a standard patent.
Alternatively, you may be able to file a provisional application, which is a relatively inexpensive way to give you 12 months to consider the commercial worth of your invention and to resolve issues such as finance and licensing. You will then be in a better position to decide if further effort in pursuing patent protection by filing a standard patent or the like is worthwhile.
 
Similarly, you can file an international application, which allows you to defer the costs of obtaining patent protection overseas, while you decide which foreign markets should be protected.
In any case, be sure not to disclose your inventions to anyone before proceeding with your application unless it is done in strict confidence. In some cases, you could unwittingly forfeit your rights to your intellectual property.
