DESIGNS - ENFORCEMENT OF YOUR RIGHTS |
|
Before you can enforce your rights to
your design, your registered design must be certified
following an examination. The examination process
confirms the newness and distinctiveness of your design.
This can be undertaken in preparation for enforcement of
your rights in infringement proceedings, or requested by
other interested parties.
Upon examination of newness and
distinctiveness, more emphasis is placed upon any
similarities that it shares with any designs in the
prior art base than differences between them.

- searching prior art in
preparation for new applications, or

action against alleged infringers of your design,
