TRADE MARKS - WHAT IS A TRADE MARK |
A Trade Mark is a word, logo or
device which links goods and services to a particular
manufacturer or supplier. They are used to
distinguish the goods and services of one trader from
those of another. The difference between Trade Marks,
business, company and domain names can sometimes cause
confusion. Please note that registration of a business,
company or domain names do not in itself confer any
proprietary rights. Only the registration of a trade
mark will give you:
- the exclusive right to
apply the trade mark in relation to the goods
and services specified in the registration;
- the exclusive right to
authorize other people to use your registered
trade mark for the goods or services specified
in the registration;
- the right to assign the
trade mark as personal property; and
- the right to serve the
Australian Customs Service a notice objecting to
the importation of goods that infringe your
registered trade mark
